Articles of Incorporation and Bylaws

Discussion, comments and questions about the Articles of Incorporation and the Bylaws were reviewed.  A considerable amount of time was devoted to this. A suggestion was made by Cheryl Culberson to read the Articles of Incorporation and the Bylaws out loud to point out the changes.  After this a motion was made by Cheryl that all scribers changes be accepted.  The motion was made and seconded, then accepted.  The votes for the proposed changes were counted during the meeting and the proposed changes to both the Articles of Incorporation and the Bylaws were accepted.

Public vs. Private roadways in VS

Homeowner, Jim Bellizzi stated that he believes all roads in VS were and still are private roads owned by the VS property owners.  Jim has hired an attorney, Jim Lupino.  At the last Islamorada Village meeting they presented information that Jim Bellizzi believes proves this.  Jim has requested that the Village ascertain that the VS roads are private.

In 1986 there was a lawsuit by VSHA against Monroe County to make the roads on the open canals  (Palermo, San Remo, Valencia, Leoni, Stromboli, Giardino, Milano, Severino, Villabella, and Bayview) deeded public.  The county has deeded them public roads.

In 1997 the roads transferred from Monroe County to the new Islamorada Village by statutory deed, not a quit claim deed.  Since then the Village has treated these roads as public roads; providing trash removal, repairs and resurfacing as well as public access.

There were numerous homeowners that spoke on the merits on both sides of this issue. 
*Those in favor of private roads listed security, control of traffic flow, control of the type of sewer system and placement of lines in the road and increased property value. Private roads are an opportunity that once the roads are deemed public is very difficult to change back to private. 
*Those in favor of public roads commented on the fact that it would be an illusion of security since the canals allow access by water.  Better security would only occur with additional costs.  There were concerns about private road maintenance costs, additional sewer costs to bring the sewer lines down Venetian Blvd and all the streets and additional cost for trash, landscape waste and recycle pick-up. 
Public vs Private Roads

How many homeowners/property owners BELIEVE that the roads (on the open canals) southwest of Venetian Boulevard are CURRENTLY PUBLIC?   24 votes believe PUBLIC    82.8%

How many homeowners/property owners BELIEVE that the roads southwest of Venetian Boulevard are CURRENTLY PRIVATE   5 votes believe PRIVATE   17.2%

Landscaping:  Barry Alter described the landscaping improvements and canal end cleaning and beautification.  This phase has been completed.  Many thanks go to Jack Connelly for his help with this project.  Jack and Susan Connelly have moved out of state and will be missed.

Village Interactions
*Thank you to the sheriff’s department and to the Village council members, Deb Gillis and Don Achenberg for their attendance at this VS Annual Meeting.  Also thank you for the helpful support with disruptive renters and support through-out the year.
Question:  Does VS have a list of short term rentals.  Answer: No.  Contact the Village.

*Weekly Vegetation Removal by the Village
The median is maintained by A & N landscaping on a weekly basis.  The debris was previously piled up for several months before being removed by the Village in 2008.  In the beginning of 2009 arrangements were made for A & N landscaping to remove the debris weekly and Venetian Shores paid them for this service.  As the cost increased, Jack Connelly made arrangements with the Village to have the debris removed weekly at no cost.  The landscaper comes on Saturday and the Village comes Monday to remove the debris.  This has been working better then in the past when the debris was left for months and has decreased VS costs.  Jim and Donna Bellizzi strongly disagreed, they stated that they think that it is unsightly and looks like a trash dump. 

*Sewer/ waste water treatment mandate by 2015-2020 is still undetermined.  The North Plantation system is still not functioning properly.  It is and will be costly to repair and correct.  3:2 vote by the Village council to continue to sewer the rest of Islamorada unfunded.  The estimated cost is $25,000 per EDU up to $40,000.  A group of concerned citizens has a law suit against the Village of Islamorada claiming the assessments are not equitable.

Crime
Palo De Oro has had multiple boat thefts.

Ballots are kept anonymous by using a two person system.  One person opens the envelope a second person counts the anonymous ballot.   Thanks to Josie Piedra and Rosemary Hymes. 

New News
*New Directors are Sergio Ayala, Tom Bray and Suzanne Sigel.

*The changes to the Articles of Incorporation and the Bylaws were accepted.

Nancy Cavallaro reminded everyone that the VSHA Picnic would be held tomorrow, Sunday, January 17, 2010 from 12:30 -4:30PM at Founders Park.  This is sponsored by the entertainment committee which is funded entirely by donations, not membership dues.  All VS property owners are encouraged to attend.  Donations are greatly appreciated.

A motion was made to adjourn the meeting by Stan Margulies and seconded by Diane Ziomek.
The meeting was adjourned at 11:50 am.
